Benign Mesothelioma

Dallas and Houston Mesothelioma Attorney
Benign Mesothelioma
Since mesothelioma remains dormant before showing signs of symptoms, benign types of this condition are seldom seen. As attacking particles of asbestos gather in the linings of the lungs and stomach, the cellular membranes that encase those internal organs try to ward off the cancerous assault. This causes tumors to form, and as they grow they can begin putting pressure on the stomach and lungs causing a great amount of pain. Luckily, benign mesothelioma tumors can be surgically removed if they are caught in time. During the surgery there is a possible risk of leaking of pleural fluid that could drip into the lung cavity, but proper drainage eliminates this as a considerable threat.

Although mesothelioma in its benign form isn’t a valid threat to life, it shows evidence of considerable exposure to asbestos. Once benign mesothelioma is discovered by a doctor, an investigation is started to determine if the patient is at risk from any other conditions related to asbestos.

Benign tumor tissue is not cancerous, but it can still be a serious health threat if no action is taken to treat it. Benign pleural diseases and asbestosis should still be considered as valid health concerns.

It is a more serious form of mesothelioma, but is usually found 7-20% of the time. The 3rd type of mesothelioma cell is a mixture of both types of mesothelioma cells and occurs about 20-35% of the time.

In addition to being 3 types of mesothelioma cells, there are 3 types of mesothelioma each affecting a different part of the body. The 3 types of mesothelioma are pleural mesothelioma, peritoneal mesothelioma, and pericardial mesothelioma.

Politics and Limits on Mesothelioma Lawsuits

Dallas and Houston Mesothelioma Lawyer
Politics and Limits on Mesothelioma Lawsuits
Over ten years ago, the Supreme Court ordered Congress to create asbestos legislation that would help mesothelioma lawsuits move through courts fast. The motivation behind this ruling was to stop bogging down the court’s time with mesothelioma cases where the plaintiff was obviously in the right, and to help these victims claim compensation faster and easier with the help of a qualified attorney. Unfortunately, this did not help victims of the deadly cancer, but instead has been used in an attempt to help industry leaders stop having to pay out as much money for the asbestos-related diseases they caused.

As early as the year 2000, the first mesothelioma-related bill was drafted. This bill, dubbed The Fairness in Asbestos Compensation Act, would create a separate Department of Justice office to deal solely with asbestos-related diseases. The bill went through four years of rewrites before it was finally defeated in the final round of votes. If this act had passed, many more suffering asbestos victims would be able to get compensation without sludging through the long court process and needing to hire a skilled mesothelioma layer.

In 2004, Senator Owen Hatch entered a bill into Congress that would place a cap on all mesothelioma awards and set up much more strict standards in order to be eligible for these awards. Under this proposed legislation, asbestos companies would pay money into a trust fund, where it would be waiting for victims to claim it. One of the worst parts of this bill is the fact that if the trust ran out, asbestos companies would still not be subject to lawsuits, leaving cancer patients and their families fend for their own when it came to paying for medical expenses and funerals on their own. Many mesothelioma specialists warned the trust fund value of $140 billion would be nowhere near enough to cover all of the asbestos victims. The American Thoracic Society warned that the definition of mesothelioma in the bill was outdated and old. While mesothelioma and asbestiosis can hit families of workers who dealt with asbestos and victims be afflicted after only working with the substance for a few months, the proposed legislation would only cover people who worked asbestos for over five years. Fortunately this bill, favored largely asbestos companies was not signed into law.
To this day, our country still has not outlawed the use of asbestos, let alone created a strong asbestos legisation.. If you or a loved one has mesothelioma, you will need a top mesothelioma attorney to help you claim compensation for your losses. Your mesothelioma lawyer can even help you learn more about the potential legislation that may affect mesothelioma in the future.

A History of the Mesothelioma Lawsuit

Mesothelioma Lawyer
A History of the Mesothelioma Lawsuit
In 1966 the first mesothelioma-related asbestos lawsuit was filed in the U.S. This case was lost but a second mesotehlioma suit was filed by a co-worker of the first plaintiff. The second mesothelioma case was won and the plaintiff was awarded $80,000.

During the succeeding years more mesothelioma lawsuits were filed. A massive fraud was uncovered as a conspiracy began to unravel and employees found out about the dangers of asbestos. Basically, upper management was aware of the connection between asbestos and mesothelioma from the work done in other countries but withheld this from their employees.

A deposition was taken in 1978 from a plant manager who divulged the "Hush, Hush" policy, in which the company would not discuss medical results that would suggest a link between mesothelioma and asbestosis. Fraud and conspiracy were revealed through documents that emerged during this period of time. These documents show that direct efforts were made to hide the hazards of asbestos as early as the 1930’s.

Mesothelioma litigation took on a new perspective due to the exposure of the fraud and conspiracy. Victims of mesothelioma could hope to receive higher monetary awards due to the punitive nature of the verdicts.

As most of the asbestos companies have gone bankrupt, large sums of money were set aside by the courts for those who have suffered due to the conspiracy and fraud that surround mesothelioma
